This is an action against a real estate broker and one of his salesmen to recover an alleged secret profit.

As stated in the complaint, the cause of action was substantially as follows: Plaintiffs owned an interest in a city lot, as vendees under a contract for the purchase thereof. Two dwelling-houses were situated upon the land. In October, 1942, they listed the premises with the defendant Frank L. McGuire, as broker, for sale at a price of $2750.
