Pending before the Court is a Motion for Partial 'Dismissal filed by Defendants Exal Corporation (“Exal”) and Nancy Spencer (“Spencer”). ECF No. 5. Pursuant to Federal Rule of Civil Procedure 12(b)(6), Defendants move the Court to dismiss Plaintiffs claim for intentional infliction of emotional distress. ECF No. 1 at PagelD #: 6, ¶¶ 72-76.
