Plaintiff appeals from a judgment of non-suit entered in an action for damages for fraud in the sale of real property.

The complaint, filed on August 6, 1958, alleges that on June 7, 1951, the plaintiff entered into a written contract with defendants to purchase their property for $12,700 and that the transaction was thereafter consummated.
