CURTIS, J. —
This is an action for damages for personal injuries sustained by the plaintiff when she struck her head against a ceiling board while ascending a stairway alleged to have been negligently maintained by the defendant Mannings, Inc. The jury returned a verdict in favor of the plaintiff in the sum of $1,500. Thereupon the defendant moved for a judgment notwithstanding the verdict upon the ground that the evidence not only failed to show that defendant was guilty of negligence, but established the fact that the plaintiff’s injuries were the result of contributory negligence.
