This case is before us on an appeal by the defendant from a judgment entered in favor of the plaintiff and order denying a new trial. The action was instituted- by the plaintiff to recover damages for alleged assault and battery committed upon the plaintiff by the defendant claiming damages in the sum of $5,000. The defendant by his answer denied each and every allegation contained in plaintiff’s complaint. As a further answer, the defendant alleges that the plaintiff first assaulted the defendant and was engaged in the act of beating and bruising him, and that, if this defendant struck or…
