This matter is before us upon the respondent ’s appeal from a final decree of the Superior Court entered upon a petition filed under the Workmen’s Compensation Act. The petitioner seeks to recover compensation from the respondent for injuries alleged in the petition to have been sustained by the petitioner by reason of accident arising out of and in the course of his employment by the respondent.
