Appeal from Sac Circuit Court. This is an appeal by the plaintiff from an order setting aside a judgment against the garnishee, and granting a new trial.

1. Nett trial: absence of dent: discretion of court. The garnishee was garnished on execution as a supposed debtor of T. J. Harwick. He appeared at the next term of the court, and .. . , . his answers were taken m open court, m which he denied that he was m any manner . " indebted to the defendant, or that he had any property in his possession belonging to him. Plaintiff filed a pleading controverting the answers, and the cause was continued.
