When plaintiff’s barn and other property were damaged by a fire on May 12, 1944, there was in effect a policy issued by defendant for insurance in the amount of $3,000 on the barn and insurance on the other property for an amount in excess of the damage thereto, which the parties agreed was $659.09. In relation to the barn, there was a dispute as to whether or not plaintiff sustained a total loss, as he claimed, and that therefore defendant was liable to him for the coverage of $3,000 on the barn.
