Lees v. Middlesex Insurance
Supreme Court of Connecticut
1Opinion of the CourtBorden, J.
The certified issue in this appeal is whether the Appellate Court correctly concluded that the claims of the plaintiff, Marion Lees, under the Connecticut Unfair Insurance Practices Act (CUIPA); General Statutes (Rev. to 1981) § 38-60 et seq.1; and the Connecticut Unfair Trade Practices Act (CUTPA); General Statutes § 42-110a et seq.2; are barred by the one *647year limit of General Statutes (Rev. to 1981) § 38-983 for a suit on a fire insurance policy. We conclude that the plaintiffs claims are not barred and accordingly reverse the decision of the Appellate Court.
