Before the Court is the defendants’ Motion for Summary Judgment on the Plaintiffs Claims and for Partial Summary Judgment on Counts I and III of the Defendants’ Counterclaim pursuant to Federal Rule of Civil Procedure 56 (“Rule 56”) in the above-captioned matter.
