Appellants/Cross-Appellees Michael M. Mintz and Paul Silvers were indicted in the United States District Court for the Southern District of Florida on three counts: conspiracy to import marijuana in violation of 21 U.S.C. §§ 952(a) and 963, importation of marijuana in violation of 21 U.S.C. §§ 952(a), and conspiracy to possess marijuana with intent to distribute in violation of 21 U.S.C. § 846 (“Florida conspiracy”).
