Motion to quash the writ of error sued out in this ease and dismiss the case has been presented by defendant in error. The grounds of the motion are, first, that the writ of error was improvidently issued because plaintiff in error neglected and refused to pay accrued costs in said suit in the court below before praecipe praying for writ of error was filed; second, that prior to the issuance of said writ defendant in error protested against its issuance unless plaintiff in error should first pay all costs accrued against defendant in error; and third, that prior to the issuance of said writ…
