Plaintiff-Appellant Kenneth Zeran (“Plaintiff’) appeals from an order of the district court granting DefendanL-Appellee Diamond Broadcasting, Inc. (“Defendant”) summary judgment. Defendant cross ap peals the district court’s denial of Defendant’s application for costs. After a background section, each matter is considered in turn.
