The above-named cases were • consolidated for trial and are presented upon this appeal on one transcript. The appeal in both cases is from the judgment entered in favor of the respective plaintiffs.

The record shows that on or about the seventh day of April, 1931, the plaintiffs were operating a Ford truck, driving northerly on the state highway in the county of Tehama; that the defendant was driving a Buick automobile in a southerly direction on the same highway.
