The appellants in this cause are the plaintiffs, against whom judgment was rendered by the trial judge sitting without a jury. Plaintiffs were the owners of a tractor and trailer oil tank, which they rented to defendant, a copartnership, for the purpose of storing road oil needed on a construction job near Hayfork, California. The road construction was being done by N. W.
