This is an appeal from a judgment of nonsuit in an action of assumpsit upon a policy of public liability insurance issued by the defendant company to J. C. Ehrlich, the plaintiff. The policy insured the holder against liability to others, under specified circumstances and conditions, for injuries or death resulting from the operation of the insured’s fumigating business.
