Kilpatrick, while driving his motor truck, 22 feet long, from Greenway Avenue across the tracks of appellee’s trolley lines on Fifty-eighth Street intersection, received personal injuries as the result of a collision between his motor vehicle and two of appellee’s cars. He had on the truck as a guest, Carlin, a minor who was also injured. Separate actions were brought and the court below directed a nonsuit in each case which it later refused to disturb.
