Frensley Bros. Lumber Company brought this action in the district court of Carter county against Pa£ Whitfield and Travis Deaton to recover the sum of $1,132.46 for lumber and material alleged to have been furnished by plaintiff to defendants Whitfield and Deaton, for the construction of a dwelling house and a garage on a tract of land consisting of about 76 acres, under an alleged contract with defendant Whitfield, and to foreclose a materialman’s lien on said land.
