Plaintiff in error, hereinafter called defendant, was convicted in the court of common pleas of Oklahoma county of operating a motor vehicle on the public highways, without having obtained a permit from the Corporation Commission, and was fined |750.

Defendant is charged with a violation, of section 3711, Oída. St. 1931, as amended by section 6, c. 156, Session Laws 1933. The charging part of the information is:
