The defendant was charged with one ■Roy O’Brien in the common pleas court of Oklahoma county with the offense of operating a motor vehicle upon the public highway for transporation of passengers for compensation without first having .obtained from the Corporation Commission a permit; was tried, convicted and adjudged to pay a fine of $300, and has appealed to this court.

The defendant urges two grounds for reversal of this case:(1) Because of the insufficiency of the evidence to sustain a conviction.(2) Misconduct of the county attorney in the trial of said case.
