The plaintiff in error will be referred to herein as defendant, and the defendants in error as plaintiffs, as they appeared in the trial court.

The plaintiffs commenced this action in the district court of Okmulgee county against the defendant on the 11th of June, 1921. The plaintiffs alleged that they are the owners of a certain tract of land in Okmulgee county on which they had sold an oil and gas lease to ene J. H.
