This is an action to recover money alleged to have been paid by the plaintiff to the defendant as the price of certain corporate stock. The plaintiff appeals from the judgment and from an order denying his motion for a new trial.

The complaint alleges that Gorrill was the manager of a corporation known as the Pacific Car Equipment Company; that on the fifteenth day of April, 1899, he offered to sell to Spreekels three hundred shares of the stock of said company at the price of twenty-two thousand five hundred dollars; that for the purpose of inducing Spreekels to buy said stock Gorrill at that…
