Eleven actions against respondent for damages resulting from the overflow of waters of the Los Angeles River during a storm in March, 1938, were consolidated and tried before a jury. By stipulation, the actions were first tried upon the question of respondent’s liability. At the close of the evidence on this phase of the ease respondent made a motion for a nonsuit and a motion for a directed verdict, both of which were denied.
