MEMORANDUM OPINION

ELLIS, District Judge.

This is a suit originally brought by seventy eight (78) 1 present and former lieutenants of the Fairfax County Fire and Rescue Department (the “Department”) seeking compliance with the overtime provisions of the Fair Labor Standards Act, 29 U.S.C. § 201 et seq. (“FLSA” or the “Act”). Plaintiffs claim they are nonexempt employees under the Act and are thus entitled to premium compensation for hours worked in excess of the statutory standards.
