Appeal (1) from an order of the Supreme Court at Special Term, entered June 5, 1969 in Broome County, which granted a motion by defendants for summary judgment dismissing the complaint, and (2) from the judgment entered thereon. On May 22, 1964 plaintiff and Edward W. Trenholm entered into an agreement for the sale of certain land owned by plaintiff in a large tract that plaintiff was developing as a shopping center in the Town of Vestal, New York.
