The plaintiff is one of eight persons who on the tenth day of September, 1909, posted notice of a placer mining location on the northwest quarter (N. W. 14) of section two (2), township twenty-two (22), south range seventeen (17) E. M. D. M., and being 160 acres of the public domain in the Kettleman Hills district. A copy thereof was recorded in the office of the county recorder of Kern County on the twenty-eighth day of November, 1909, which was one day after the President of the United States made his order withdrawing the lands from entry.
