OPINION
HEWITT, Judge.
This matter comes before the court on Defendant’s Motion for Summary Judgment (Def.’s Mot.). Plaintiff, Ryco Construction, Inc. (Ryco), is an engineering and construction company based in Gardena, California. Complaint (Compl.) at ¶ 5. In its complaint, plaintiff asserts a right to compensation for road repair work done in Los Padres National Forest, California under a contract with the United States Forest Service. Id. at ¶¶ 3-4.
