In lieu of granting defendant Brigadier General Contractor Incorporated’s application for leave to appeal, the Supreme Court has remanded this case to this Court for consideration as on leave granted. Defendant appeals the decision of the Worker’s Compensation Appellate Commission (wcac) reversing the magistrate’s decision denying plaintiff benefits after the magistrate found that defendant was not liable as a statutory employer.
