MEMORANDUM AND ORDER
GLASSER, District Judge.
Plaintiff Howard Robinson (“Robinson”) commenced this action against defendant Overseas Military Sales Corporation (“OMSC”) under the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 621, et seq., and against the remaining defendants under the ADEA and 42 U.S.C. § 1983.
