In this case the first question called to our attention by the arguments of counsel is whether the bill of exceptions was filed in time to become a part of the record.-' If this question is answered in the negative, in accordance. with the contention of the defendant in error, then we cannot notice’ any of the rulings of the trial court which have been assigned for. error.
