VAN VAEKENBURGH, District Judge.
Defendant in error, plaintiff below, was the owner of a number of city warrants issued by plaintiff in error, defendant below, a city of the third class, in 1891 and 1892; these warrants were all duly presented to the city treasurer within less .than fivé years after their issue and duly indorsed, as required by law, “Not paid for want of funds.” They were payable only out of the general revenue fund of the city.
