MUNGER, District Judge.

The defendant in error had a verdict and judgment against the plaintiff in error in an action for breach of a contract. The parties will be referred to as they appeared in the-trial court. The defendant in error has submitted a motion to strike *829the bill of exceptions, because it was not allowed in the time provided by law for that purpose. The verdict was returned and the judgment was entered at the May term of the court. A motion for a new trial was filed during that term.
