This action of tort was brought in the District Court to recover compensation for bodily injuries to the plaintiff and damage to his automobile sustained when the automobile, operated by the plaintiff on the highway, was run into by a horse owned by the defendant and driven by his son. The declaration contains a count alleging that the son was not a proper person to have control of the horse.
