This is an appeal from a judgment of the district court allowing 'the claim of the respondent against the estate of John Birkholz, deceased, in the sum of $19,066.05.

On June 4, 1915, the decedent entered into a contract with respondent reciting that he and she were husband and wife but had separated and were living apart, that respondent had brought suit for a divorce, and that he and she desired to adjust their property rights in case a divorce was granted. Decedent accordingly promised to pay respondent $1,000 a month during her lifetime, to transfer to the Minneapolis Trust…
