Action by plaintiff, as "cceiver of an insolvent bank, to enforce an assessment upon the stockholders, in which plaintiff had judgment, and defendants appealed from an order denying their motion for a new trial.
The facts are as follows: The Allemannia Bank was a banking corporation organized under the laws of this state. It became insolvent — ■ unable to pay and discharge its obligations — and, in proceedings to wind up its affairs, plaintiff was appointed its receiver.
