MILLER, Judge.

This case is before the court on defendant’s motion to dismiss or, in the alternative, for summary judgment. The issues to be decided are (1) whether a contract between farmers and the United States exists by virtue of the farmers having submitted a qualified application for a loan note guarantee pursuant to the Consolidated Farm and Rural Development Act and its implementing regulations; and (2) if no such contract is found to exist, whether the Court of Federal Claims otherwise has jurisdiction to hear their claims for fraud, breach of fiduciary duty, and violation of…
