This is a suit for a balance claimed for a contractor’s services in building a residence and appurtenances for defendant. It is alleged that the parties met in April, 1937, and discussed the project; it was proposed that the contractor should furnish materials and perform the contract on a cost-plus basis; the interview resulted in the understanding that the probable cost of the project would be $330,500, and that plaintiff should receive a contractor’s fee of $25,000 for its services.
