By an information, defendant was charged with a violation of section 459 of the Penal Code (burglary). This was alleged to have occurred on or about November 17, 1965, in the Broadway Department Store. It was also alleged that defendant had suffered a prior conviction of the crime of assault with a deadly weapon, a felony, in Los Angeles County on July 31, 1959. Defendant was arraigned and pleaded not guilty. He denied the prior conviction. Trial was set for February 4, 1966. On defendant’s motion, the case was advanced to January 14, 1966.
