• This matter is before the court on the motion of defendant for partial summary judgment and/or dismissal. (Doc. 79). Plaintiff alleges that defendant terminated him from defendant’s employ on thé-basis of plaintiffs age. Plaintiff brings this action under the -Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. §§ 621 et seq.; the Kansas Act Against Discrimination (“KAAD”), K.S.A. §§ 44-1001 et seq.; and a common law claim of breach of an implied employment contract.
