Action in the municipal court of the city of Duluth to recover the purchase price of candy ordered by defendant from plaintiff. Plaintiff is a manufacturer of candy at Cleveland, Ohio. Defendant is a grocer at Superior, Wisconsin. On May 4, 1920, C. M. Haugner, then in charge of defendant’s confectionery department, gave the order to Barney Sands, one of plaintiff’s traveling salesmen. Sands wrote the order and left a copy with Haugner.
