I. BACKGROUND
The following facts are derived from the pleadings and the parties’ submissions on the present motion.
This action arises from alleged misappropriation and infringing use of the plaintiffs’ computer software source code and ancillary material by the defendant, Rocket Software, Inc. (“Rocket”).
