On April 4, 2007, Plaintiffs Gary Fried-rich Enterprises, LLC and Gary Friedrich (“Friedrich”) (together, “Plaintiffs”) filed this action alleging unlawful use of Plaintiffs’ “Ghost Rider” characters and story. On June 8, 2007, Defendants moved to dismiss the Complaint in part pursuant to Federal Rule of Civil Procedure 12(b)(6). On May 19, 2009, this Court referred Defendants’ Motion to the Honorable James C. Francis IV, United States Magistrate Judge.
