MEMORANDUM AND ORDER

HUTTON, District Judge.

Presently before the Court are Defendant’s Motion to Compel an Independent Psychiatric Examination of Plaintiff pursuant to Rule 35 of the Federal Rules .of Civil Procedure, and Plaintiffs opposition thereto.

I. BACKGROUND

In this action, the plaintiff, Nagesh Shirsat (“Shirsat”), seeks to obtain damages for psychiatric harm resulting from the alleged wrongful termination of his employment with the defendant, Mutual Pharmaceutical Company, Inc.
