The petitioner-appellant was indicted for murder in the first degree by an Brie County Grand Jury in May of 1925. On March 12, 1926, he was apprehended in the State of Massachusetts, was returned to Buffalo on March 13, 1926, under police custody, and was placed in solitary confinement. He was not immediately arraigned. On the morning of March 17, 1926, he was interviewed by the District Attorney in his oEce for the first time.
