The opinion of the county judge follows:

Conable, J.

The relator was indicted by the grand jury of

the county of Monroe February 5, 1937, for the crime of grand larceny, second degree. On the same day he was arraigned in the Monroe County Court and plead guilty as charged. On February 16, 1937, an information was filed by the district attorney charging him with having been previously convicted of a felony. He admitted being the same person so convicted and on the same day was sentenced to imprisonment in the Attica State Prison for an indeterminate term of not less than five nor more than ten…
