Appeal by the plaintiff, Carl L. Vietor, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of New York on the 19th day of March, 1921, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 28th day of March, 1921, denying plaintiff’s motion for a new trial made upon the minutes.

The complaint herein sets forth the following facts: Defendant is a domestic banking corporation organized under the laws of the United States, and having its principal place of business in the borough of Manhattan, city of New York. About May 24, 1920, for value received, it duly issued and delivered to plaintiff (doing business under the firm name of Bockhill & Vietor) a letter of credit dated May 24, 1920, in the following form:
