This case is before the court on defendant’s motion for summary judgment and plaintiff’s cross-motion for summary judgment. Plaintiff is seeking an order of ejectment and payment of all rent due and owing, plus interest, under the terms of a lease and lease modification. Defendant denies owing any sums to plaintiff and contends that an enforceable contract for sale was formed under the option to purchase provision of the lease.
