OPINION
LYDON, Senior Judge:
This case is before the court on the parties’ cross motions for summary judgment. At issue is whether plaintiff violated the terms of his contract with the United States Department of Agriculture (USDA). The parties entered into the contract pursuant to the Diary Termination Program (DTP), which was enacted as part of the Food Security Act of 1985, 7 U.S.C. § 1446(d) (Supp. V 1987).1 Plaintiff’s complaint challenges a determination by the USDA’s Deputy Administrator for State and County Operations (DASCO) that plaintiff is no longer eligible to receive compensation…
