OPINION
HOFFMAN, Senior Judge
Third Party Plaintiff-Appellant Hager-man Construction Corp. (Hagerman) appeals the trial court’s denial of its motion for summary judgment. We affirm in part and reverse in part.
Hagerman presents two issues which we consolidate and restate as: whether the trial court erred in denying Hagerman’s motion for summary judgment.
