Larry Magness sought recovery from Gust K. Newberg Construction Company ("GKN") for injuries resulting from a fall while working on a construction project in Indianapolis for which GKN was the general contractor. GKN, after settling with Magness pursuant to an Agreed Judgment, brought an indemnity complaint against Magness's employer and GKN's subcontractor, Starnes Trucking, Inc. ("Starnes").
